Abstract

The right to education is universally recognized as a fundamental human right, enshrined in Universal Declaration of Human Rights U/A 26 and recognized in numerous international instruments and domestic constitutions, and essential for individual empowerment, social cohesion, and economic development. Yet, for transgender and gender‑diverse individuals, the realization of this right remains fraught with systemic barriers, institutional neglect, and legal uncertainty. Across the globe, transgender students face disproportionately high rates of harassment, exclusion, and violence within educational settings, which severely impair their academic performance, mental health, and opportunities. While many jurisdictions have progressively expanded legal protections for gender identity and expression, a persistent chasm persists between the normative promises of anti‑discrimination law and the lived realities of transgender learners. long‑term life This gap often characterized as the divergence between law in books and law in action constitutes the central socio‑legal problematic of transgender education: how can legal frameworks be effectively mobilized to transform schools into spaces of genuine inclusion, safety, and dignity for all students, irrespective of their gender identity.
