Abstract

Constitutional amendments significantly influence the institutional structure and democratic governance of a state. This study critically examines the proposed 27th Constitutional Amendment to the Constitution of Pakistan, 1973, with particular emphasis on its impact on the judiciary, judicial independence, and the constitutional balance of powers. Using a qualitative doctrinal legal research methodology, the study analyzes the amended constitutional provisions alongside relevant judicial principles and contemporary scholarly literature. The analysis demonstrates that the amendment introduces a Federal Constitutional Court, redistributes constitutional jurisdiction, restructures judicial appointment and accountability mechanisms, and alters the traditional relationship between the judiciary, executive, and legislature. While these reforms may improve specialization in constitutional adjudication and reduce the workload of the Supreme Court, they also raise significant concerns regarding judicial autonomy, executive influence, constitutional supremacy, and the rule of law. The study concludes that the long-term constitutional success of the amendment will depend upon transparent implementation, institutional independence, and continued adherence to democratic constitutional principles.
