ADR IN FAMILY AND COMMUNITY DISPUTES: A SOCIO-LEGAL PERSPECTIVE

While ADR is an effective and legally sound approach to disputes in family and community, its potential to prove successful in Pakistan requires comprehensive legal reforms, professional standards for mediation, institutional support, public awareness and ensuring fairness and equality for weak and vulnerable members of society.

Abstract

Alternative Dispute Resolution (ADR) is proving to be a major tool for the settlement of disputes without the involvement of the courts. In Pakistan, where litigation is expensive, the courts face delays and the process is very tedious, ADR offers an easily available, efficient and relationship-oriented justice system. Family and community conflicts are often well suited for ADR because these relationships are typically ongoing and relationships can be worsened by a court proceeding. Mediation, conciliation, arbitration and negotiation are used to make decisions together and keep families together and cohesive. Socio-legally, ADR is more of a social institution whose function is mediated by cultural norms, religious values, economic realities and community structures other than just a legal mechanism. In Pakistan, balancing the traditional nature of dispute resolution as per custom and culture with constitutional protection and statutory provisions, and the principles of fairness are vital to the success of ADR. Islam has a strong tradition of reconciliation, consultation and peaceful dispute resolution, which aligns with the values of ADR, as well as with the many legal reforms of the present day. The socio-legal perspective of the issues raised in this paper is to consider the role of ADR in family and community disputes, through the lenses of the existing legal framework, Islamic principles, international practices and obstacles in the way of its implementation in Pakistan. It asserts that, although the potential benefits of ADR for access to justice are great, ADR must be supported by trained mediators, institutional support, judicial cooperation, public awareness and protection of vulnerable parties, especially women and children. The paper argues that the improvement of the ADR institutions can help foster a more available, effective and fair justice system, sustain social harmony and alleviate court pressure.
